Terms & Conditions

Critical Account Recovery warning

Because Foxcolab Mail utilizes a client-side zero-knowledge architecture, we hold no database copies of your master passphrase or decryption keys. **If you lose your login credentials or recovery seals, our support team cannot recover your account, reset your password, or retrieve your emails.**

1. Acceptance of Terms

By accessing, registering for, or using the Foxcolab Mail client application and SMTP/IMAP gateway servers (the "Service"), you agree to be bound by these Terms and Conditions. These terms establish a legally binding agreement between you ("User" or "Customer") and Foxcolab Technologies. If you do not agree, you are not authorized to access or deploy the Service.

2. User Cryptographic Obligations

In deploying client-side zero-knowledge credentials, you take full responsibility for:

  • Configuring a strong, resilient master passphrase for key derivation client-side.
  • Safeguarding local backup files containing private encryption keys.
  • Maintaining local backups of recovery configurations and active secure session keys.

We provide no guarantee of service continuity or data retrieval if local keys are deleted or corrupted due to user action, hardware failure, or device operating system errors.

3. Acceptable Use Policy (AUP)

Our SMTP, IMAP, and API gateways are dedicated to secure, high-integrity professional communications. You explicitly agree not to use the Service to:

  • Transmit unsolicited commercial bulk email messages ("Spam" or "UCE").
  • Distribute malicious software payload links, virus configurations, or phishing attacks.
  • Engage in email address spoofing or attempt to impersonate external domains not verified on your dashboard.
  • Attempt to overload gateway ports through automated connection flooding scripts.

Any violation of these guidelines will result in the immediate rate-limiting or isolation of the offending account. Because email contents are encrypted, our outbound filters analyze structural metadata at the gateway level (e.g. rate per minute, bounce indices) to enforce these parameters.

4. Custom Domain Verification

To configure a custom domain under your organization directory, you must demonstrate ownership control by publishing authorized MX, SPF, and DKIM DNS records.

By verifying a domain, you warrant that you are the legitimate owner or possess clear authorization from the registrant. We reserve the right to suspend email sending functions for any domain that becomes subject to registry disputes, intellectual property claims, or is reported for spam activities on global block lists.

5. Service Warranties & SLA Limits

Foxcolab Mail is provided on an "as is" and "as available" basis. While we leverage distributed database rings configurations to target 99.99% operational uptime:

  • We make no warranties that the service will meet all specific operational profiles.
  • We are not liable for outbound SMTP mail delays caused by destination mail servers blocking TLS connections.
  • We will not be held liable for any indirect, incidental, or consequential damages resulting from data loss.

6. Governing Law & Dispute Resolution

This agreement is governed by the laws of Switzerland. The exclusive venue for any legal actions or claims arising from the use of the Service shall be the competent courts of Basel-Stadt, Switzerland.
